How Many Years Do Names Stay on the DWI Hit Parade?
To the Editor:
How many years do you list these names. There's a matter of public record but on
the other hand theres a matter of harassment. After a couple of years I believe
it becomes harassment. Also, there are some cases (one in which I'm familiar
with) that the person received probation before judgment and because the time
was completed without any arrest this person can withdraw the guilty plea and
all charges have been dropped. Isn't it fair that the name is also
dropped? What about those found to be innocent?
Greg S.
(Editor's Note: Since you didn't use your last name, it
is likely you are simply referring to yourself. This arrest of yours is a
fact. It is also a fact, regardless of the disposition of the case due to good
work on the part of your lawyer, that you were endangering the lives of others
by carrying your partying out onto our highways. A 'probation before judgment'
disposition simply means that the record reflects easy treatment of your charge,
provided you not break the law for one year.
If you feel harassed over the continual listing of your name in the DWI Hit
Parade, consider how those who lost loved ones to drunk drivers worry about your
tender feelings when their family member's name is listed on a headstone in the
cemetery for eternity.
For 17 years we have made no bones about it, drink and drive and get
arrested in Southern Maryland and your name is going in the DWI Hit Parade.
Since 1998, this service to our readers has been expanded to our online edition
and is convenient for insurance companies and those doing background checks to
find out more about those who seek insurance or employment. We have published
the names of approximately 38,000 people, many of them more than once, some as
often as five or six times. This effort has been undertaken to convince people
not to drive after drinking.
All you have to do to keep this from happening to you is to call a cab,
which is a lot cheaper than an attorney, higher insurance rates, fees to the
health department for drunk driver monitoring programs, interlock devices for
your vehicle and, even, a casket.
Make the right decision to not drive after drinking. We have never had anyone
contact us to say they were found innocent in court. This isn't something that
actually happens. Some people get lenient treatment but none receive the death
sentence, which is what happens to victims of drunk drivers. We had one driver
contact us to say his arrest was bogus and an interview with him was published.)
