Toddler Killed in Crash Not Wearing Belt or in Car SeatWashington Metropolitan Police report that at approximately 11:45 pm, Friday, October 29, 2004, a 2004 Honda Accord was traveling northbound on I-295 when it apparently struck the rear of a 2001 Nissan pickup truck that was also traveling northbound. The pickup truck flipped over several times before coming to a rest just north of Howard Road, SE.

A 3-year-old male occupant of the truck, identified as Desmond Payne of the 2100 block of Ingraham Street in Hyattsville, Maryland, was ejected from the vehicle. He was taken to Children’s Hospital and pronounced dead. Another child in the truck, identified as Desmond’s 18-month-old brother, Mikylo Payne, also of the Hyattsville address, received injuries and was also taken to Children’s Hospital and admitted in stable.

The driver of the Nissan, a 31-year-old Hyattsville, Maryland, man and father of the two children, refused treatment. The driver of the Honda, a 34-year-old Fort Washington, Maryland, man, also refused treatment. Their names are being withheld at this time since no charges have been filed.

The case is currently under investigation by members of the department’s Major Crash Investigations Unit who will determine the cause of the accident and if the placement of any charges are warranted. At this time it appears neither of the children were in child restraint seats.
